Judge George A. OToole, Jr: ELECTRONIC ORDER entered. Having considered the petitioner’s application for a writ of habeas corpus pursuant to 28 U.S.C. § 2241 (dkt. no. 1 ) and the government’s response (dkt. no. 7 ), the Court GRANTS the application IN PART. Within seven days of this Order, the respondents shall provide the petitioner with a bond hearing at which the government bears the burden to either (1) prove by clear and convincing evidence that the petitioner poses a danger to the community or (2) prove by a preponderance of the evidence that the petitioner poses a flight risk. See Hernandez-Lara v. Lyons, 10 F.4th 19, 41 (1st Cir. 2021). The parties shall file a joint status report within ten days of this Order stating whether the petitioner has been released on bond, and if the petitioner’s bond request is denied, the report shall state the reason or reasons therefor. The petitioner shall not be removed from this District pending further order of the Court. It is SO ORDERED.(FGD) (Entered: 05/13/2026)
