MINUTE ORDER (1) Granting Motion to Proceed in Forma Pauperis, (2) Denying Without Prejudice Petition, and (3) Denying as Moot Motion to Appoint Counsel. As previously ordered by this Court, see Minute Order, Rodriguez-Pinto v. Warden, Case No. 26-CV-1608 TWR (MMP) (S.D. Cal. entered March 24, 2026), ECF No. 7, Petitioner received a bond hearing on April 7, and April 20, 2026. After the Immigration Judge denied bond, Petitioner filed a Notice in that same case, which the Court construed as a Motion to Enforce Judgment and which the Court denied because Petitioner had failed to exhaust his administrative remedies by appealing the bond decision to the Board of Immigration Appeals ("BIA"). See Minute Order, Rodriguez-Pinto v. Warden, Case No. 26-CV-1608 TWR (MMP) (S.D. Cal. entered May 12, 2026), ECF No. 10. Now before the Court is Petitioner's second 1 Petition. As an initial matter, the Court GRANTS Petitioner's 2 Motion for Leave to Proceed in Forma Pauperis. As for the Petition, Petitioner again seeks review of the Immigration Judge's denial of bond. Although the Court is sympathetic to Petitioner, Petitioner again has failed to exhaust his administrative remedies by appealing to the BIA or to raise any basis for waiving the administrative exhaustion requirement. The Court therefore DENIES WITHOUT PREJUDICE Petitioner's 1 Petition, see Leonardo v. Crawford, 646 F.3d 1157, 1161 (9th Cir. 2011) (remanding with the instruction to dismiss the petition without prejudice because the petitioner had not exhausted his administrative remedies or demonstrated grounds for excusing exhaustion), and DENIES AS MOOT Petitioner's 3 Motion to Appoint Counsel.
