District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. In opposing this habeas petition, the respondents cited violations by the petitioner of the conditions governing his humanitarian parole as a basis for his October 2025 arrest. See Doc. No. 6 at 4 (referencing “several ATD violations”); Doc. No. 6-1 at 4 (stating ICE detained petitioner “due to ATD violations”). The respondents do not elaborate on the nature of the violations in their memorandum, nor are they further described in the supporting exhibits. In his reply brief, the petitioner questions the existence of such violations. See Doc. No. 10 at 4-5, 8 (noting respondents have not described violations and asserting arrest occurred while petitioner was “complying with” ICE’s directions). This question bears on the respondents’ authority to detain the petitioner. Accordingly, by January 15, 2026, the respondents shall submit a supplemental declaration describing the violations referenced in their papers—i.e., the date(s) and nature(s) of any violations by petitioner of the conditions governing his supervision by ICE from the time of his release in December 2024 through the date of his arrest in October 2025—with any reports or other contemporaneous documents memorializing such violations included as exhibits to the declaration.(FGD) (Entered: 01/08/2026)
