ORDER denying 12 Motion for Temporary Restraining Order: Petitioner has filed a Motion for Temporary Restraining order asserting that Petitioner advised counsel that, based on this interaction, he believes ICE intends to remove him tomorrow morning, August 12, 2026, at approximately 6:00 a.m. Dkt. No. 12 at 2. Respondents are under a court order to provide at least 48 hours advance notice prior to removal, and that notice must be filed on the docket. Dkt. No. 7 at 2. As no notice has been filed, and Petitioner has not provided any evidence that he will be removed, the Court DENIES his motion. However, the Court reminds Respondents (and their officers, employees, agents, or others working on their behalf) that they are under a Court order and MUST provide Petitioner(s) and Petitioner(s)' counsel in this habeas action at least 48 hours' notice (or 72 hours' notice if the period extends into a weekend, holiday, or date the Court is closed) prior to any action to move or transfer any Petitioner(s) from the Western District of Washington or to remove them from the United States. ORDER granting 15 Motion for Temporary Restraining Order. Respondents (and their officers, employees, agents, or others working on their behalf) are temporarily PROHIBITED from transferring Petitioner from this district or removing Petitioner from the United States pending further order of this Court. See A.A.R.P. v. Trump, 605 U.S. 91, 97 (2025) (Federal courts have the power to issue injunctive relief to prevent irreparable harm to the applicants and to preserve [] jurisdiction over the matter.). This ex parte Order will remain in place for fourteen (14) days. If Petitioner wishes to extend the TRO for the duration of the habeas litigation, Petitioner must file a preliminary injunction motion. The parties are directed to (1) meet and confer on a briefing schedule for a preliminary injunction motion, including whether the TRO may be extended while the motion is briefed, and (2) contact the assigned judge's chambers to confirm how they wish to proceed. Petitioner's Counsel is admonished for waiting nearly forty-eight hours after receiving the notice of removal to file the emergency motion and creating more of an emergency than was necessary.
