Emergent Immigration Habeas Non-transfer Order
#6
Jul 08, 2026
TEXT ORDER - The Court acknowledges receipt of Respondents' letter (ECF No. 6) advising that Petitioner was transferred to the Karnes County Immigration Processing Center in Karnes City, Texas prior to the filing of the Petition (ECF No. 1) and prior to the entry of this Court's transfer injunction (ECF No. 2). A petition for writ of habeas corpus under 28 U.S.C. § 2241 generally must be filed in the district of confinement and name the petitioner's immediate custodian as respondent. See Rumsfeld v. Padilla, 542 U.S. 426, 434-35 (2004). Because the record reflects that Petitioner was confined in Texas at the time this action was commenced, this Court lacks jurisdiction over the Petition. Id. Accordingly, in the interest of justice, the Clerk shall TRANSFER this matter to the United States District Court for the Western District of Texas pursuant to 28 U.S.C. § 1631 and CLOSE this case. So Ordered by Judge Karen M. Williams on July 8, 2026. (Williams, Karen) (Entered: 07/08/2026)
