Order on 25 Motion for Reconsideration. On 2/5/26 this Court entered an Order granting 9 Petition for Writ of Habeas Corpus, to the extent it sought an individualized bond hearing before an immigration judge. It is now the understanding of the Court that Petitioner's order of removal became final on 1/28/26. This fact was not reflected anywhere on the docket at the time of the Court's ruling. The Government filed its 20 Response in opposition on 1/29/26 with no indication that the status of Petitioner's detention had changed. Now, 8 days since the Court's order was entered the Court is learning that Petitioner's status was changed 17 days ago. In addition, the Government has failed to attach the Bureau of Immigration Appeal's final order of removal to their motion to substantiate its claim. A motion for reconsideration with respect to a final order or judgment must rely on one of three grounds: (1) an intervening change in the law; (2) the availability of new evidence; or (3) the need to correct clear error of law or prevent manifest injustice. N. River Ins. Co. v. CIGNA Reinsurance Co., 52 F.3d 1194, 1218 (3d Cir. 1995). The purpose of such a motion is "to correct manifest errors of law or fact or to present newly discovered evidence." Bootay v. KBR, Inc., 437 Fed. Appx. 140, 146-47 (3d Cir. 2011) (citing Harsco Corp. v. Zlotnicki, 779 F.2d 906, 909 (3d Cir. 1985)). Until the government produces and files with this Court the Bureau of Immigration Appeal's final order of removal, the 25 Motion for Reconsideration hereby is DENIED. Signed by Judge Stephanie L.
