TEXT ORDER. It does not appear that the Petitioner is detained within this District. See Emergency Petition for Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241 (ECF 1) 1 (indicating that the Petitioner is detained at the "Moshannon Valley ICE Processing Center in Phillipsburg, Pennsylvania"); see also id. 10-11 (same). So the Court may not have jurisdiction. See Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004) (noting the "general rule that for core habeas petitions challenging present physical confinement, jurisdiction lies in only one district: the district of confinement); see also Khalil v. Joyce, 777 F. Supp. 3d 369, 397 (D.N.J. 2025) ("There are hard territorial limits on a habeas court's jurisdiction. This Court's habeas power ends at the state line."). In light of the above, the Court is inclined to transfer this case to the Western District of Pennsylvania. See 28 U.S.C. § 1631 (empowering district courts to transfer civil cases to courts in which they could have been filed to address jurisdictional defects).
