ORDER. ORDERED that Respondents shall show cause in writing within seven (7) days from the date of this Order i.e., by August 4, 2026, why the Petition [ECF 1 ] should not be granted. In their Response, Respondents should address the statutory basis for Petitioner's detention, the circumstances surrounding his arrest including the grounds for the same, and any information concerning Petitioner's immigration proceedings that may be material to the Court's determination. Additionally, because Petitioner has "provide[d] good reason to believe that there is no significant likelihood of removal in the reasonably foreseeable future, the Government must respond with evidence sufficient to rebut that showing." Zadvydas, 533 U.S. at 701. FURTHER ORDERED that within twenty-one (21) days of Respondents answer to this Order to Show Cause, Petitioner may file a reply. FURTHER ORDERED that within seven (7) days form the date of this Order, i.e., by August 4, 2026, the parties shall complete and file the Election Concerning Consent/Non-Consent to United States Magistrate Judge Jurisdiction form [ECF 4 ], indicating either the unanimous consent of the parties or that consent has been declined.
