EO: The Parties are DIRECTED to file supplemental briefing no longer than 10 pages by noon on 7/1/2025 regarding whether 8 U.S.C. § 1252(g) deprives this Court of jurisdiction. The parties should address the cases Petitioner raised during the 6/27/2025 hearing including, Kong v. United States, 62 F.4th 608 (1st Cir. 2023) and Arce v. United States, 899 F.3d 796 (9th Cir. 2018). They should also discuss Prado v. Perez, 451 F. Supp. 3d 306 (S.D.N.Y. 2020); You v. Nielsen, 321 F. Supp. 3d 451 (S.D.N.Y. 2018); Michalski v. Decker, 279 F. Supp. 3d 487 (S.D.N.Y. 2018); and Davis v. Garland, 2022 WL 17155828 (W.D.N.Y Nov. 22, 2022). Finally, the Court invites the parties to submit any other cases they consider relevant in determining what "arising from" means in the context of Section 1252. The Court would encourage the parties to focus on habeas cases that challenge a petitioner's mandatory detention.
