Text Order DENYING [] Motion for Immediate Release (contained in petition). Because the relief Petitioner now seeks on a preliminary and ex parte basis is essentially identical to the ultimate relief sought on the merits of this already-expedited habeas proceeding, the Motion is DENIED. The Court will resolve Petitioner's request for relief by ruling on the merits of the writ itself. See Garcia-Aleman v. Thompson, No. 25-CV-00886-OLG (W.D. Tex. Oct. 30, 2025) (collecting cases) (Dkt. No. 20). Signed by Judge Orlando L. Garcia. (This is a text-only entry generated by the court. There is no document associated with this entry.) (ks1)

ORDER FOR SERVICE--Upon review, it is ORDERED that notice of electronic filing (NEF) of the Petition (Dkt. No. 1) and this Order to the United States Attorney in San Antonio, Texas shall constitute service on the Federal Respondents, as required by the Rules Governing § 2254 Cases1 and Federal Rule of Civil Procedure 5, and on all Respondents unless otherwise contested.2 It is further ORDERED that Respondents must file a response to the Petition (Dkt. No. 1) within 7 days of electronic service. The Court construes the Petition as raising, at least in part, a Fifth Amendment Due Process claim which Respondents should address. See, e.g., Bonilla Chicas v. Warden, __ F. Supp.3d __, No. 26-CV-131, 2026 WL 539475, at *6 (S.D. Tex. Feb. 20, 2026); Marceau v. Noem, No. 26-CV-237-KC, 2026 WL 368953, at *1 (W.D. Tex. Feb. 9, 2026). The response must identify all pertinent factual and procedural background information, including: (a) the date Petitioner entered the United States; (b) whether Petitioner was previously apprehended and then released by immigration authorities; and (c) the status of Petitioners immigration and/or removal proceedings.. Signed by Judge Orlando L. Garcia. (mgr) (Entered: 06/29/2026)
