TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus and Motion for Protective Order / Preliminary Injunction of Petitioner Remeterio Requena ("Petitioner") pursuant to 28 U.S.C. § 2241. (ECF Nos. 1, 2.) Petitioner alleges that he has been continuously detained at Delaney Hall Detention Facility since February 9, 2026, following the entry of an order of removal to Ecuador, or alternatively Honduras, and that those countries have allegedly declined to accept his removal. Petitioner further alleges that, on June 29, 2026, the Immigration Court entered an order modifying his removal to Peru based on a joint motion that he contends was not the product of his knowing and voluntary consent, and that he has since filed emergency motions to reopen, reconsider, vacate that order, and stay removal, which remain pending before the Immigration Court. Based on these allegations, Petitioner contends that his continued detention is indefinite within the meaning of Zadvydas v. Davis, 533 U.S. 678 (2001), and/or has become unreasonably prolonged in violation of the Due Process Clause. Accordingly, Respondents SHALL file an answer to the Petition within seven (7) days, including: (1) the statutory authority under which Petitioner is currently detained; (2) the current status of Petitioner's immigration proceedings, including the pending emergency motions before the Immigration Court and any effect those proceedings have on the finality of the removal order; (3) whether Petitioner's removal is reasonably foreseeable; and (4) Petitioner's claim that his continued detention is unlawful under Zadvydas and the Due Process Clause. Respondents SHALL also file the relevant administrative record, including all custody determinations, bond hearing decisions, orders of removal, subsequent immigration court orders, and records pertinent to Petitioner's detention and anticipated removal. Petitioner may file a reply within three (3) days of receipt of Respondent's answer. Petitioner shall not be transferred from the District of New Jersey during the pendency of these proceedings.
