District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The petitioner, a citizen of the Dominican Republic, has filed a petition pursuant to 28 U.S.C. 2241 challenging his detention by the respondents. Doc. No. 1. He was detained and then released on parole by immigration officers when he entered the United States in 2022, was permitted until recently to remain at liberty (presumably on conditions of supervision imposed by the respondents), and was arrested after the respondents terminated his parole on June 9 because “[t]here is now bed space available” for his detention. Doc. No. 9-1; see Doc. No. 1 at 4. The petitioner challenges the lawfulness of his detention. He alleges he has never been charged with or convicted of any crime and has never failed to appear for any court proceedings. Doc. No. 1 at 4. The respondents do not contest these facts, nor have they identified any change in circumstances specific to this petitioner, such as a violation of the conditions of his supervision or pending criminal charges, to justify terminating or otherwise altering his release status. See Doc. No. 9. They concede he is not subject to mandatory detention. See id. (conceding detention is governed by 8 U.S.C. 1226).In light of the foregoing, the Petition is ALLOWED. Because the respondents unlawfully terminated the petitioner’s release without any change in circumstances bearing on the risk of flight or danger to the community he poses, and without any process (let alone due process), the Court finds that ordering a bond hearing is not an adequate remedy. See Murzi v. Noem, No. 26-cv-359, 2026 WL 395111, at *1-2 (D. Colo. Feb. 12, 2026) (citing cases reaching same conclusion). Accordingly, the respondents shall IMMEDIATELY RELEASE the petitioner, no later than 6 PM today, July 2, 2026, and they shall not retaliate against him for the filing of this habeas petition. The respondents shall file a status report by July 6, 2026, confirming that the petitioner was released in compliance with this Order.(SED) (Entered: 07/02/2026)
