TEXT ORDER: This matter comes before the Court upon Petitioner Maria Maudalena Orozco Sandoval's ("Petitioner") Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241 (ECF No. 1 ), alleging she is unlawfully detained by immigration authorities under 28 U.S.C § 1225(b)(2) without a bond hearing. Respondents filed a letter brief in response to the Petition (ECF No. 6 ) ("Response"). Respondents stipulate that Petitioner has been in ICE custody without a bond hearing since November 2025. (Response at 1.) Respondents acknowledge that they rely on the same statutory interpretation set forth in Matter of Yajure Hurtado, 29 I&N Dec. 215 (BIA 2025), rejected by many courts within this district and across the country, for the statutory authority to detain Petitioner without a bond hearing. See Valerio v. Joyce, No. 25-17225, 2025 WL 3251445, at *3 (D.N.J. Nov. 21, 2025) (collecting cases). Therefore, for the same reasons stated in Valerio, the Court finds Petitioner is detained under 8 U.S.C. § 1226(a) and is entitled to a bond hearing. The Court, consequently, GRANTS the Petition. (ECF No. 1 .) Respondents shall provide Petitioner with a bond hearing in conformance with 8 U.S.C. § 1226(a) and 8 C.F.R. 236.1(c)(8) and (d)(1), within seven days of the date of this Order. Within three days of the bond hearing, the Government shall e-file correspondence advising the Court of the outcome of the bond hearing, at which time the Court will close this matter.
