FINDINGS and RECOMMENDATIONS (Text Only): Petitioner (A No. 215 920 495) proceeds with a 1 Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241. On 12/8/2025, the District Court judge assigned to this case ordered by way of temporary restraining order that, among other things, Petitioner be released from ICE custody. On 12/23/2025, the court issued a preliminary injunction on the same terms as the temporary restraining order. The court agrees Petitioner was entitled to release for the reasons stated by the District Court judge and there is not good cause to otherwise revisit Petitioner's habeas claims. Accordingly, IT IS HEREBY RECOMMENDED that the Petition for a Writ of Habeas Corpus be GRANTED, the preliminary injunctive relief previously ordered be made permanent and this case be CLOSED. These Findings and Recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within 14 (fourteen) days after being served with these Findings and Recommendations, any party may file written objections with the court and serve a copy on all parties. Such a document should be captioned "Objections to Magistrate Judge's Findings and Recommendations." Any response to the objections shall be filed and served within 14 (fourteen) days after service of the objections. The parties are advised that failure to file objections within the specified time may waive the right to appeal the District Court's order. Martinez v. Ylst, 951 F.2d 1153 (9th Cir. 1991).
