Minute Order by Judge Jinsook Ohta: Petitioner filed a petition for writ of habeas corpus on June 5, 2026, naming the Senior Warden of the Adelanto Detention Facility, among others, as Respondent. Dkt. 1. Both the petition and the government represent that Petitioner has been continuously detained at the Adelanto Detention Facility, which is located in the Central District of California. See Dkt. 1 PP. 36, 60; Dkt. 4.The proper respondent in a habeas action is the petitioner's immediate custodian, and jurisdiction lies in the district of confinement. Rumsfeld v. Padilla, 542 U.S. 426, 43435 (2004). Because Petitioner was confined in the Central District of California when he filed the petition, this Court lacks jurisdiction over his habeas claims. Accordingly, in the interest of justice, the Court VACATES the July 2, 2026 hearing and TRANSFERS this action to the United States District Court for the Central District of California pursuant to 28 U.S.C. § 1631.
