ORDER granting the 1 Petition for Writ of Habeas Corpus to the extent it seeks an individualized bond hearing before an immigration judge, and, in light of this relief, the 7 Motion for Temporary Restraining Order/Preliminary Injunction is moot. See Calzado Diaz v. Noem, No. 3:25- cv-458, 2025 WL 3628480 (W.D. Pa. Dec. 15, 2025) (Haines, J.), vacated as moot, ECF No. 22 (Dec. 17, 2025) (the legal conclusions in Calzado are unaffected by the mooting of the order due to the individual facts of Mr. Calzado Diaz's case); A.D. v. Leonard Oddo et. al., No. CV 25-460J, 2026 WL 101476, at *1 (W.D. Pa. Jan. 14, 2026). The Government is directed to provide Petitioner with the statutory process required under 8 U.S.C. 1226, which includes a bond hearing. The Government shall arrange for an individualized bond hearing to be conducted by an immigration judge by February 6, 2026. If Petitioner is not provided with a bond hearing by February 6, 2026, or if the immigration judge declines to conduct a bond hearing based on Hurtado, Respondents shall immediately release Petitioner from custody. The parties shall provide notice to the Court of the outcome of the individualized bond hearing within seven days of the date of the immigration judge's decision. To the extent that Petitioner seeks to enjoin transfer outside of the Commonwealth of Pennsylvania, this Court lacks authority to grant that relief as the places of detention for aliens pending removal is left to the discretion of the Attorney General. 8 U.S.C. § 1231(g)(1). See also Sinclair v. Atty Gen., 198 F. Appx 222 n.3 (3d Cir. 2006). Finally, Petitioner's request for immediate release goes beyond the "limited nature of a [T.R.O.]" and instead requests "mandatory, affirmative relief[,]" which may not be afforded via a T.R.O. Hope v. Warden York County Prison (Hope I), 956 F.3d 156, 162 (3d Cir. 2020) (finding that where the district court purported to enter an ex parte T.R.O. but directed the release of twenty petitioners, the relief altered the status quo, exceeding the temporary and limited nature of a [T.R.O.]) (citing Granny Goose Foods Inc. v. Brotherhood of Teamsters and Auto Truck Drivers Local, 415 U.S. 423, 439 (1974)).With no further action required by the Court at this time, the Clerk of Court shall mark this matter closed.
