ORDER denying 3 Motion to Expedite and for Immediate Emergency Hearing, and 4 Motion for Temporary Restraining Order. Per Petitioner's filing, he is subject to a Final Order of Removal and states that removal is imminent. Under 8 USC 1252(a)(5) and (b)(9), district courts lack jurisdiction to review most claims relating to removal because judicial review of a final order of removal is available only through a petition for review in one of the circuit courts of appeal. The Third Circuit has interpreted the jurisdictional bar to review of issues relating to removability broadly. See Khalil v. President of the United States, 164 F.4th 259 (3d. Cir. 2026). Petitioner's claim does not present the sort of "now or never" claim subject to review that is contemplated by Khalil. And the Supreme Court has made clear that "final orders of removal may not be reviewed in district courts, even via habeas corpus, and may be reviewed only in the courts of appeals." Nasrallah v. Barr, 590 U.S. 573, 57980 (2020). As such, the 3, 4 motions are DENIED, and the Court will consider Petitioners 1 Petition for Writ of Habeas Corpus. Signed by Judge J. Nicholas Ranjan on 6/29/2026. STANDING ZADVYDAS ORDER. In alien habeas cases, petitioners often challenge their detention as being unconstitutionally prolonged, either at the outset or later during the pendency of their cases. See Zadvydas v. Davis, 533 U.S. 678 (2001) ("The serious constitutional problem arising out of a statute that, in these circumstances, permits an indefinite, perhaps permanent, deprivation of human liberty without any such protection is obvious.") In order to monitor and assess the validity of any such potential claim, Respondents shall file a status report updating the Court on Petitioner's detention status six months from today.
