(Text-Only) ORDER: Petitioner filed a Motion for Emergency Injunctive Relief [ECF No. 7] seeking to enjoin his movement outside of the District of Minnesota while his habeas petition is pending. Petitioner identifies four grounds to support his request. None of these supports granting his motion. (1) The probability that Petitioner will succeed on the merits of his petition has little bearing on the location he is detained. If Petitioner prevails, he would be ordered released in Minnesota regardless of where he is detained at that time. (2) Petitioner's inability to care for two young children is the result of his detention, not his detention's location. This concern is better addressed through the prompt adjudication of Petitioner's claims and, if he prevails, through an order that he be released in Minnesota on an expedited basis. (3) The health conditions Petitioner identifies are substantial, but as Petitioner describes the situation, they are exacerbated by his detention, not the location of his detention. (4) The court would retain jurisdiction over the Petition regardless of whether Petitioner is transferred to a detention facility in another state, and as the case stands, it is difficult to see how a transfer might impair Petitioner's ability to communicate with his counsel in a way that would, in turn, prejudice Petitioner's claims or prosecution of the case. (TEXT-ONLY) Order: Petitioner Cesar M.P. has filed a Motion for Emergency Injunctive Relief [ECF No. 12]. The motion will be DENIED. Although Petitioner states that his transfer to Texas is imminent, there is no record evidence to support that removal from the United States will occur before the objection period on the R&R expires. Cesar's transfer to another district before the R&R objections are resolved will not deprive this Court of jurisdiction over reviewing the R&R. And contrary to Petitioner's argument, see ECF No. 12 at 5, if Petitioner succeeds on the merits, there is no basis to believe that an immigration court conducting a bond hearing in another jurisdiction will not provide a hearing that complies with its due process obligations.
