MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 8/7/2026. Respondents filed a second motion to extend time to respond to Petitioner's amended petition for writ of habeas corpus. (ECF No. 12 (Motion).) Petitioner opposes the Motion, arguing the reasons offered do not amount to good cause and citing prejudice from the delay. (ECF No. 13 .) Respondents filed the Motion around at 4:59 PM on August 5, 2026 the same date their response was due. As the Court has reiterated to this same counsel on two other occasions in the last week, this practice of filing for an extension on the same date as the deadline is disfavored and, without more, inhibits finding good cause. See Mendez v. Blanche et al., Case No. 2:26-cv-01854-MMD-BNW (D. Nev. July 29, 2026) (ECF No. 12); Rodriguez v. Mattos, Case No. 2:26-cv-02125-MMD-DJA (D. Nev. July 31, 2026) (ECF No. 8). The Court agrees with Petitioner that work load and staffing issues are insufficient to establish good cause. The Court additionally notes that Respondents' assertion that they require more time because "this case is fact-intensive" is conclusory. (ECF No. 12 at 1, 2.) However, upon review of the amended petition (ECF No. 9 ), the Court finds it would benefit from a "comprehensive response" from Respondents. (ECF No. 12 at 1.) The Court therefore will grant the Motion. (ECF No. 12 .) Respondents have until August 12, 2026 to file their response to the amended petition. However, the Court further directs Respondents to file Petitioner's "complete Alien File including the 1984 immigrant visa petition and packet and any naturalization record for Maria Deserato" as requested by Petitioner by Monday, August 10, 2026. MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 8/11/2026. By Deputy Clerk: Karen Walker.The Court ordered Respondents to file Petitioner's complete Alien File as Petitioner has requested by August 10, 2026. (ECF No. 14 .) Respondents filed a status reporting indicating in part that Petitioner's Alien File will need to be redacted to protect the privacy of the alien (i.e., Petitioner). (ECF No. 15 .) Respondents failed to indicate when the redacted Alien File will be available to file. Moreover, it is not clear why the Alien File will require redaction if it is provided to Petitioner via his counsel.
