District Judge Leo T. Sorokin: ELECTRONIC ORDER entered. The Court has reviewed the petition and the answer filed today, in which the respondents acknowledge that Petitioner is eligible for a bond hearing conducted pursuant to 8 U.S.C. § 1226(a) but nevertheless urge the Court to deny the petition for reasons including Petitioner’s alleged failure to exhaust. See Doc. No. 13. As documents submitted by the respondents show, Petitioner requested a bond hearing before an immigration judge in writing on June 22, 2026. Doc. No. 13-3. The Court infers from his filing of a habeas petition the next day that Petitioner had not yet been informed by the respondents that his written request for a bond hearing would be honored by the respondents. It was reasonable, then, for Petitioner to seek a Court order requiring this relief. The respondents have now noted that a bond hearing has been scheduled for July 6, 2026. Doc. No. 13 at 1 n.1. In light of that representation and the respondents’ concession that Petitioner is entitled to a bond hearing held pursuant to 8 U.S.C. § 1226, it is hereby ORDERED that the legal standard governing Petitioner’s scheduled hearing is as established by the First Circuit in Hernandez-Lara v. Lyons; that, should the immigration judge find that the government has met its burden of proof as to flight or danger, they shall consider whether any condition, combination of conditions, or less-restrictive alternative to detention would ameliorate such risk; and that the respondents shall not retaliate against Petitioner for the filing of this action. The parties shall file a joint status report by July 8, 2026, notifying the Court of the outcome of the bond hearing.
