TEXT ORDER: Before the Court is the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, filed by Petitioner's next friend, Cristina Mateo Silven. (ECF No. 1). Assuming Ms. Silven qualifies as a next friend and thus has standing, she is not an attorney. Thus, she cannot litigate this case on Petitioner's behalf. See, e.g., Banks ex rel. Waymer v. Eddy, 801 F. App'x 50, 51 (3d Cir. 2020) ("A non-attorney cannot represent another party, even if acting as a next friend."); Schlemmer v. Cent. Intel. Agency, 804 F. App'x 127, 128 n.2 (3d Cir. 2020) (citing cases). However, Ms. Silven has also filed a Motion to Appoint Pro Bono Counsel, (ECF No. 2), and the Court having determined that appointment of counsel is appropriate in the interests of justice pursuant to 18 U.S.C. § 3006A and the applicable habeas rules, it is ORDERED that the Federal Public Defender for the District of New Jersey is appointed to represent Petitioner for purposes of this habeas matter through the conclusion of the proceedings in this Court. Appointed counsel shall file any amended petition, along with the filing fee or application to proceed in forma pauperis, within three (3) days of this Order.
