MINUTE ORDER (Text Only Entry) This Court received this case several days ago upon transfer from the Northern District of California and continues to review the extensive record. Applicant for intervention CoreCivic moved yesterday (Doc. 119 ) for an expedited ruling on its motions to intervene and to stay. The administrative motion is GRANTED IN PART. The Court will endeavor to rule on the question of intervention in the coming days on the papers without oral argument. See Local Rule 230(g). However, the Court is concerned that the briefs related to the motion to stay are stale given the subsequent issuance by the Judge Chesney of a memorandum of decision (Doc. 111 ) providing further reasoning in support of the injunctive relief order. In the interest of judicial efficiency, as soon as possible but no later than April 13, 2026, the parties SHALL meet and confer in a good faith attempt to reach agreement on a stipulated schedule for re-briefing that motion considering the full record and SHALL promptly either file a stipulation memorializing an agreement or a brief status report outlining the results of that effort. To the extent the parties are not already aware, they are informed that the undersigned is receiving several dozen emergency motions a week while simultaneously handling an extraordinarily heavy criminal and civil caseload, so matters MUST be presented as efficiently and concisely as possible signed by District Judge Jennifer L. MINUTE ORDER (Text Only Entry) Having reviewed the parties' joint status report (Doc. 132 ) in light of the entire record, the Court provides the following observations: First, the Court is concerned that the parties have not presented this matter in the most efficient manner, particularly given the inability (or unwillingness) of the Government to further clarify its appellate position at this time. This Court does not have the resources to address issues multiple times and will not do so here. Second, Plaintiffs appear to have legitimate concerns about the prejudice that may flow from CoreCivic's delayed full engagement in issues that were thoroughly briefed and presented to Judge Chesney from late December 2025 through early February 2026. For example, declarations from California City's Warden (Doc. 38-1) and CoreCivic's Chief Medical Officer (Doc. 38-1) were presented to Judge Chesney by Federal Defendants and were discussed extensively at the February 6, 2026 hearing. (See Doc. 75.) Yet CoreCivic nonetheless maintains in its motion to intervene that the Court was not fully informed about its current operational status and efforts to comply with the constitution. (See Doc. 82-1.) Relatedly, CoreCivic expresses what appear to be legitimate concerns about the practical consequences of the injunction and about how it is apparently being excluded from discussions about implementation of the injunction at its own facility, which will impact its own operations and employees. Yet, notably, CoreCivic has only requested intervention for the limited purposes of appeal and to file a motion to stay pending the appeal, not to improve its access to ongoing or future proceedings. For all these reasons, the Court believes it would be best for the parties to re-brief the motion to intervene to address the full scope of any proposed intervention based on the current record. In any such renewed motion, the Court directs CoreCivic to address with specificity why it was unable to present to Judge Chesney all material information, including information included in the March 3, 2026 Declaration of Christopher Chestnut, as the reason for the delayed presentation may be material to the Court's intervention analysis. Given CoreCivic's representation that the External Monitor plans to inspect the Facility sometime in May, these issues, and any request to stay, will be considered on an expedited basis. In a perfect world, the Court believes the parties should be able to come to an agreement on some aspects of CoreCivic's intervention request. But, at the very least, the Court expects the parties to meet and confer once more to propose a reasonable schedule for a renewed motion to intervene and stay.
