ORDER TO SHOW CAUSE: Upon consideration of Petitioner's Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241, ECF No. 1, IT IS HEREBY ORDERED that: 1) Petitioner shall cause a copy of this Order and Petitioner's application for relief to be served on Respondent by November 25, 2025; 2) Petitioner shall file proof of service on the docket by November 26, 2025; 3) Respondent is ORDERED to show cause, in writing, why the Petition for Writ of Habeas Corpus should not be granted by December 1, 2025 at 5:00PM.Further, to preserve the Court's jurisdiction pending a ruling on the petition, Petitioner shall not be removed from the Eastern District of New York or the United States until further Order of this Court. ORDER. On November 25, 2025, the Honorable Sunshine S. Sykes issued an order granting the plaintiff petitioners' motion for class certification in Lazaro Maldonado Bautista et al v. Ernesto Santacruz Jr, 2025 WL 3288403 (C.D. Cal. Nov. 25, 2025). In this order, Judge Sykes certified a nationwide class and extended "the same declaratory relief" that Judge Sykes had previously "granted to Petitioners to the Bond Eligible Class as a whole." Id. at *9. The Court directs the parties to address whether Mr. Padilla Molina is a member of this nationwide class and the impact, if any, of Judge Sykes's order on the instant case.
