ENDORSED ORDER. Petitioner, a national of Mexico, was detained at the Pinellas County Jail following his June 16, 2026, arrest for an invalid driver's license under Fla. Stat. § 322.03(1). (Doc. 1 at 9). The next day, Petitioner paid the $150 bond but was not released. (Id. at 10; Doc. 6-3). On June 18, 2026, Petitioner filed an Emergency Petition for Writ of Habeas Corpus seeking release from the jail, arguing that the jail's 48-hour hold pursuant to U.S. Immigration and Customs Enforcement's ("ICE") I-247 detainer request was expired. (Id. at 12-13). In anticipation of detainment by ICE, Petitioner also argued that he is not subject to mandatory detention under 8 U.S.C. §§ 1226, 1225, or 1231. (Id. at 15-25). The Court ordered a response, which Respondents promptly filed. (Doc. 3, Doc. 6). On June 19, 2026, ICE assumed custody of Petitioner. (Doc. 6 at 3-4). The same day, Petitioner agreed to voluntary departure under 8 U.S.C. § 1229c. (Doc. 6 at 7; Doc. 6-6). Thus, the Emergency Petition for Writ of Habeas Corpus (Doc. 1) is DENIED as moot. In any event, "[t]he 48-hour period begins when an individual who is the subject of an immigration detainer would not otherwise be detained (i.e., he has posted bond)" and excludes holidays. Davis v. Gregory, No. 20-12716, 2021 WL 2944462, at *2 (11th Cir. July 14, 2021). Because Petitioner posted bond on June 17, 2026, and was detained by ICE on a federal holiday on June 19, 2026, the 48-hour period had not expired. (Doc. 6-5).
