MINUTE (IN CHAMBERS) ORDER ISSUING STAY PUT AND SETTING BRIEFING SCHEDULE RE PETITIONERS APPLICATION FOR TEMPORARY RESTRAINING ORDER 2 by Judge Hernan D. Vera, Respondents are ordered tofile a response to the Application, which the Court construes as a request for a Preliminary Injunction, by June 24, 2026. The Court will hear oral argument on the Application on June 25, 2026 at 1:30 p.m. Respondents are ordered to ensure that Petitioner is physically present at that hearing. In the interim, based on the Courts inherent powers to preserve the status quo, Respondents are hereby enjoined from deporting Petitioner from the United States and enjoined from removing Petitioner outside the Central District of California. Because Petitioner has been detained within this 90-day window in accordance with a now-final order of removal, and because her two-month detention does not yet meet the presumptive standard set forth in Zadvydas,1 the Court cannot find any constitutional or regulatory violation sufficient to grant the relief requested. The Application is therefore denied. The Court's Stay-Put Order [Dkt. 9] is discharged. The parties are ordered to meet and confer regarding whether the Petition may be resolved and judgment entered for the same reasons as those articulated in this order. Within 10 days of this Order, the parties are ordered to either file a joint proposed order and judgment, or a statement of the issues that remain to be evaluated.
