ORDER denying 6 Motion for TRO Petitioner Elvin Romero Aguilar filed a Petition for a Writ of Habeas Corpus in this Court while detained at the Moshannon Valley Processing Center. On June 29, 2026, he filed an Emergency Motion for and ex parte Temporary Restraining Order 6 asserting that he has been transferred to a facility in Louisiana and that his removal from the United States in imminent. Petitioner asks for a TRO to bar his removal from the United States pending the Court's resolution of his pending habeas petition.The Court is compelled to deny the Motion for Temporary Restraining Order. Under 8 USC 1252(a)(5) and (b)(9), district courts lack jurisdiction to review most claims relating to removal because judicial review of a final order of removal is available only through a petition for review in one of the circuit courts of appeal. Further, under 8 USC 1252(g) no court shall have jurisdiction to hear any cause or claim by or on behalf of any alien arising from the decision or action of the Attorney General to commence proceedings, adjudicate cases, or execute removal orders against any alien under this chapter. Courts, including the Third Circuit, have interpreted the jurisdictional bar to review of issues relating to removability broadly. See Khalil v. Persistent of the United States, Nos. 25-2162 & 25-2357 (3d. Cir. Jan. 15, 2026). This Court lacks, therefore, the authority under the INA to issue a TRO barring removal. Nor does the All Writs Act, as Petitioner argues, supply the jurisdiction to do so. But this argument fails because §1252(g) applies notwithstanding the All Writs Act. Barrios v. Attorney General of the U.S., 452 Fed.Appx. 196, 198 (3d Cir. 2011). The All Writs Act cannot confer jurisdiction that Congress expressly limited. For these reasons, the motion for TRO 6 is denied.
