TEXT ORDER re Respondents' # 4 Status Report and Petitioners # 5 Status Report. On June 17, 2026, the Court enjoined Respondents from moving Petitioner outside the jurisdiction of the Northern District of New York until this civil action is resolved. Dkt. No. 2 . Respondents request that the order be modified to restrict Petitioner's transfer from the Northern or Western Districts of New York (DKT # 4 ). Respondents note that they don't have any opposition to amending the Courts Order to permit movement to WDNY (DKT # 5 ). Petitioner's transfer to the Western District of New York will not deprive the Court of jurisdiction over this action, see Rumsfeld v. Padilla, 542 U.S. 426, 441 (2004) (acknowledging that a district court retains habeas jurisdiction notwithstanding a subsequent transfer of the petitioner). Accordingly, Respondents' request for modification is GRANTED. It is ORDERED that Respondents are enjoined from transferring Petitioner outside of the Northern or Western Districts of New York until this civil action is resolved.
