ORDER TO SHOW CAUSE: The Court has received the 1 Petition for a Writ of Habeas Corpus, which states that Petitioner is detained at the Adams County Correctional Center outside Natchez, Mississippi. Nothing in the Petition indicates that venue is proper in this District. See Ozturk v. Hyde, 136 F.4th 382, 389-90 (2d Cir. 2025) (for a court to "entertain a habeas petition," it must be "filed in the district of confinement" (first citing Rumsfeld v. Padilla, 542 U.S. 426, 438 (2004); and then citing 28 U.S.C. Section 2242)). Petitioner is therefore ordered to show cause, by June 12, 2026, why this case should not be transferred to the U.S. District Court for the Southern District of Mississippi. To preserve the status quo and ensure Petitioner has an opportunity to have his case considered by a court where venue is proper, Respondents are restrained from removing Petitioner from the United States unless and until this Court or the transferee court orders otherwise. See Hernandaz v. Lyons, No. 26-CV-0233 (PAE), 2026 WL 145562, at *2 (S.D.N.Y. Jan. 20, 2026) (collecting cases issuing similar orders); 28 U.S.C. TRANSFER ORDER: Petitioner filed the present action on June 6, 2026, seeking a writ of habeas corpus ordering his release from immigration detention. (Dkt. 1, at ECF 6.) However, the face of the petition makes clear that Petitioner is not detained in this District, and is instead detained at the Adams County Correctional Center outside Natchez, Mississippi. (Id. at ECF 1.) On June 9, 2026, the Court ordered Petitioner to show cause no later than June 12, 2026 "why this case should not be transferred to the U.S. District Court for the Southern District of Mississippi." (6/9/2026 Order to Show Cause.) To date, Petitioner has not responded to the Court's Order. Without any response from Petitioner, the Court relies exclusively on Petitioner's allegations and exhibits. Those allegations and exhibits make plain that Petitioner is detained in Mississippi, and seemingly has been for many months prior to his filing this petition. The Court finds it to be in the interest of justice to transfer this action to the U.S. District Court for the Southern District of Mississippi, the district in which Petitioner is detained (and was detained at the time he filed his petition). See Ozturk v. Trump, 777 F. Supp. 3d 26, 42 (D. Mass. 2025) ("If a case is filed in the wrong venue, 28 U.S.C. § 1406(a) permits the district court in the district in which the case was filed to 'transfer such case to any district or division in which it could have been brought' if such transfer serves 'the interest of justice.'" (quoting 28 U.S.C. § 1406(a))); Cardenas v. Larocco, No. 26-CV-00949 (NCM), 2026 WL 473850, at *1 (E.D.N.Y. Feb. 19, 2026) (transferring habeas petition because, "[b]ased on the record before the Court, the Court f[ound] that petitioner was not detained in the Eastern District of New York at the time he filed this Petition"). The Court's June 9, 2026 Order to Show Cause which restrained Respondents "from removing Petitioner from the United States unless and until this Court or the transferee court orders otherwise" shall remain in effect, (6/9/2026 Order to Show Cause), though, by its own terms, the Order may be modified by the transferee court. The Court waives the requirement that the Clerk of Court wait seven days before effectuating the transfer under Local Civil Rule 83.1. Ordered by Judge Pamela K. Chen on 6/17/2026.
