MINUTE ORDER signed by Magistrate Judge Edmund F. Brennan on 12/12/25: Petitioner filed a petition for writ of habeas corpus on November 24, 2025 that included a request that the court enjoin respondents from removing petitioner to any third-party country. ECF No. 1 at 19. The same day, the court construed petitioner's request as a motion for preliminary injunction and ordered a response. ECF No. 5 . On December 2, 2025, respondents filed an opposition to the motion for preliminary injunction and return to the petition. ECF No. 8 . Despite the pendency of the preliminary injunction motion seeking to prevent petitioner's removal to a third-party country, respondents transferred petitioner to a processing facility in Arizona between December 6 and 8, 2025, and informed the court that they intend to remove petitioner to a third-party country (Mexico) "in the reasonably foreseeable future." ECF No. 15 . In response to that filing, petitioner (now represented by the Office of the Federal Defender) has filed a motion for a temporary restraining order seeking, among other things, an order preventing petitioner's removal. ECF No. 18 . To preserve the status quo and the court's jurisdiction to resolve the petition and the pending motions for preliminary injunctive relief, it is HEREBY ORDERED THAT respondents are temporarily enjoined from moving or transferring petitioner from the Florence Service Processing Center while the court considers the motion for temporary restraining order.
