District Judge Angel Kelley: ELECTRONIC ORDER entered. ELECTRONIC ORDER entered. Petitioner Juan Manuel Cutiupala Simbana filed a Petition for Writ of Habeas Corpus on June 15, 2026. [Dkt. 1]. That same day, the Court ordered Respondents to show cause within three business days why the facts of this case differ from those presented in Amaya Sanchez v. Moniz et al., No. 25-cv-12806-AK (D. Mass. Oct. 10, 2025). [Dkt. 3]. In Amaya Sanchez, the Court joined other sessions of this Court, and other courts across the country, in holding that the arrest and detention of noncitizens within the United States is governed by 8 U.S.C. § 1226(a). More than three business days have passed since this Court's Order to Show Cause, and Respondents have not responded. On June 21, 2026, Petitioner filed a Notice of Respondents' Failure to Comply with Order to Show Cause and Request for Immediate Relief. [Dkt. 7]. On the facts before it, the Court does not find reason to deviate from the analysis presented in Amaya Sanchez. Accordingly, Petitioner is subject to 8 U.S.C. § 1226’s discretionary detention framework and entitled to a bond hearing. He has not received such a hearing, so his detention is unlawful.Petitioner’s Petition [Dkt. 1] is GRANTED. Respondents are ORDERED to provide Petitioner with a bond hearing under 8 U.S.C. § 1226(a) within 10 calendar days of this Order. Respondents are ENJOINED from denying Petitioner bond on the basis that he is detained pursuant to 8 U.S.C. § 1225(b)(2). The parties are ORDERED to file a status report within 14 calendar days of this Order stating whether Petitioner has been granted bond, and, if his request for bond was denied, the reasons for that denial.(CEH) (Entered: 06/22/2026)

That same day, the Court ordered Respondents to show cause within three business days why the facts of this case differ from those presented in Amaya Sanchez v. Moniz et al., No. 25-cv-12806-AK (D. Mass. Oct. 10, 2025). [Dkt. 3]. On June 21, 2026, Petitioner filed a Notice of Respondents' Failure to Comply with Order to Show Cause and Request for Immediate Relief (aka Motion to Enforce) [Dkt. 7]. On June 22, 2026, in short succession, (1) Petitioner filed a Motion to Withdraw his Motion to Enforce [Dkt. 8]; (2) Respondents filed a response in which they informed the Court that Petitioner had a bond hearing scheduled for June 25, 2026 and admitted that Petitioner is eligible for a bond hearing under Section 1226(a) [Dkt. 9]; and (3) the Court entered an order granting Petitioner's Petition for a Writ of Habeas Corpus [Dkt. 10]. As the Court's June 22, 2026 order was issued without the knowledge of Petitioner's June 25 bond hearing, it is VACATED. Further, Petitioner's Motion to Withdraw [Dkt. 8] is GRANTED and his Motion to Enforce [Dkt. 7] is WITHDRAWN. The Court shall retain jurisdiction over the matter, pending Petitioner's June 25 bond hearing.
