Judge Allison D. Burroughs: ELECTRONIC ORDER entered. On June 15, 2026, Petitioner filed a petition for writ of habeas corpus, [ECF No. 1 ], which duplicates a petition filed in this Court three days previously on June 12, 2026, see No. 26-cv-12669, Dkt. No. 1 (D. Mass. June 12, 2026). Though some pages appear in a different order, the petitions are materially identical, with the later-filed petition appearing to be a scan of the earlier-filed petition. A court may “dismiss[] an action as ‘duplicative’ of another suit” if it is “satisfied that the later action is ‘materially on all fours with the other.’” Cherelli v. InStore Grp., LLC, 513 F. Supp. 3d 187, 193 (D. Mass. 2021) (quoting Cong. Credit Corp. v. AJC Int’l, Inc., 42 F.3d 686, 689 (1st Cir. 1994)); see also Sutcliff Storage & Warehouse Co. v. United States, 162 F.2d 849, 851 (1st Cir. 1947) (“There is no reason why a court should be bothered or a litigant harassed with duplicating lawsuits on the same docket; it is enough if one complete adjudication of the controversy be had.”). The Court finds here that the second petition is on all fours with the first. Accordingly, the petition is DISMISSED as duplicative of an earlier-filed petition pending before this Court.(CAM) (Entered: 06/23/2026)
