DOCKET TEXT ORDER. The court is in receipt of the Tenth Circuit's decision, published yesterday, in Santillan Quiroz v. Mullin. In it, the Tenth Circuit held that "noncitizens who entered the United States and were thereafter detained in the interior of the country are usually subject to § 1226(a) (and thus eligible for bond), and not to § 1225(b)(2)(A)." The court then found the petitioner "can properly be subject to detention under § 1226(a)" and instructed the district court to grant the petition and "order the Government to, within seven days of such order, either provide him with a bond hearing or else release him." If the parties are in agreement, consistent with Santillan Quiroz, the court will cancel today's 3 p.m. hearing, grant the petition, and order the Government to provide a bond hearing within seven days or release Mr. Torres Avila.
