Emergent Immigration Habeas Non-transfer Order

Text Order: The Court has reviewed the Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. (ECF No. 1.) According to the Petition, Petitioner is a citizen of Peru who entered the United States in November of 2022, was briefly detained and released on humanitarian parole. Petitioner further alleges that in December 2024, she filed an application for asylum, which remains pending, and in May of 2025, Petitioner was granted work authorization. Petitioner further alleges that on June 9, 2026, she was detained after voluntarily reporting to Immigration and Customs Enforcement following a missed appointment. Petitioner contends that her continued detention violates the Immigration and Nationality Act, and the Due Process Clause of the Fifth Amendment. (Id.) Accordingly, it is hereby ORDERED that Respondents shall SHOW CAUSE, on or before June 19, 2026, why the relief requested in the Petition should not be granted. Petitioner shall file a reply within three (3) business days of service of Respondents' response. Petitioner shall serve a copy of the Petition and this Order upon Respondents within two (2) business days of entry and shall promptly file proof of service on the docket. It is further ORDERED that Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings absent further Order of the Court. So Ordered by Judge Jamel K.
