(In Chambers) Order by Judge Stanley Blumenfeld, Jr.: Petitioner seeks a temporary restraining order prohibiting the government from transferring him outside this district or removing him from the United States while his habeas petition remains pending. Petitioner has not shown that the requested relief is warranted. He presents no evidence that his transfer or removal is imminent, and nothing in the record suggests that the government intends to transfer him outside the district. Moreover, General Order 26-05 requires the government to provide at least two court days notice to the petitioner... and the Court of its intent to remove the petitioner from the Central District of California. Dkt. No. 4 at 2. Should the government provide such notice, the Court will consider an appropriate application for emergency relief to preserve its jurisdiction. The Court also notes that Petitioner appears to be a member of the Bond Eligible Class certified in Bautista v. Santacruz, No. 5:25-cv-01873-SSS-BFM, 2025 WL 3288403 (C.D. Cal. Nov. 25, 2025). Accordingly, no later than June 16 at 9 a.m., the government shall file a statement setting forth its position on whether Petitioner is entitled to a bond hearing as a member of the Bautista class.
