On review the issues raised in the Petition appear similar to those addressed in this Court's prior orders concerning Respondents' compliance with 8 C.F.R. § 241.13(i)(2) in re-detaining individuals subject to a final order of removal who were previously released from custody. See Ciuciu v. Warden, California City Corrections Center, No. 1:26-cv-03274-DJC-JDP (concluding 8 CFR § 341.13(i)(2), and not § 8 U.S.C. § 1231(a)(6) applies to revocation of release following imposition of a final order of removal); see also Moua v. Warden, No. 1:26-cv-02238-DJC-JDP. Respondents are ORDERED TO SHOW CAUSE on or before August 4, 2026, as to why the Court should not grant a writ of habeas corpus by filing a return as provided in 28 U.S.C. § 2243. In such a return, Respondents should identify any factual or legal issues in this case that render it distinguishable from the Court's prior orders listed above and justify denying the petition, or indicate this matter is not substantively distinguishable. Petitioner may file a reply on or before August 6, 2026. This matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary.
