ORDER granting 24 Motion to Postpone Habeas Hearing Pending Board of Immigration Appeals Adjudication. The Petitioner asks me to postpone his habeas hearing given his just-filed motions with the Board of Immigration Appeals ("BIA"), namely, his emergency statutory motion to reopen proceedings (ECF No. 27) and emergency motion to stay removal (ECF No. 24-1). Specifically, the Petitioner requests that his habeas hearing be postponed "for good cause," 28 U.S.C. § 2243, pending adjudication of these emergency immigration proceedings. The Petitioner has established "good cause" for postponement. 28 U.S.C. § 2243. Postponement will preserve judicial resources and promote fairness to the Petitioner, who acted swiftly in securing immigration counsel and filing proceedings with the BIA. On the record before me, there are many unanswered questions. The Government's limited opposition to the motion to postpone (ECF No. 25) does not convince me that legitimate removal is actually imminent, that the Zadvydas issue is moot, or that the Government will be prejudiced by a postponement of the hearing. The Petitioner's motion to postpone the habeas hearing is GRANTED. The Petitioner is DIRECTED to file updates on the status of his pending BIA motions with this Court every thirty days and/or as soon as he receives notification from the BIA on the resolution of any of his pending motions.
