PAPERLESS ORDER. THIS MATTER is before the Court on the "Emergency Motion to Enforce Court Order, Disclose Petitioner's Location, and for Immediate Relief" ("Motion") (DE 9 ) filed on June 17, 2026 by Next Friend, Andrea De Lourdes Cruz Alvarez ("Next Friend") on behalf of Petitioner Matias Emilio Zea Cruz ("Petitioner"). On that same date, Respondents filed a response to the Petition brought pursuant to 28 U.S.C. § 2241 (""Response") (DE 8 ), which states, in pertinent part, that Petitioner remains confined at the Krome North Service Processing Center (""Krome"). Thus, Next Friend's request for more information regarding Petitioner's whereabouts because the detainee locator system "has become unavailable or severely restricted" appears to be moot. (Id. at 1.) Also, to the extent Petitioner requests immediate release from custody under 28 U.S.C. § 2241, he has already filed a habeas petition seeking the same relief (DE 1 ), therefore the instant Motion appears duplicative and unnecessary. Finally, although Next Friend designates the Motion as "expedited," it fails to comply with Southern District of Florida Local Rule 7.1(d)(2). Accordingly, it is ORDERED AND ADJUDGED that Petitioner's Motion (DE 9 is DENIED and Respondent need not file a response addressing the merits of the Petitioner's Motion. Should Signed by Judge Kathleen M. Williams (nn) (Entered: 06/18/2026)
