TEXT ORDER re 1 Petition for Writ of Habeas Corpus filed by the petitioner. To maintain the status quo, and solely so that the Court can make an informed decision about its authority to issue relief and whether any relief that it has the power to issue should be granted, the respondents are temporarily enjoined from removing the petitioner from the United States. Additionally, so that the petitioner can fully participate in these proceedings and maintain adequate access to legal counsel, the respondents also are enjoined from transferring the petitioner outside the Western District of New York. TEXT ORDER: Based on the parties' submissions and the oral argument held on December 19, 2025, the Court has determined that the petitioner is likely to succeed on his petition in light of this Court's decision in Ceesay v. Kurzdorfer, 781 F. Supp. 3d 137 (W.D.N.Y. 2025). As a result, this Court hereby orders that on or before December 22, 2025, De Paz Velasco shall be temporarily released from ICE custody pending further briefing by the parties. ICE may, in its discretion, choose to release Da Paz Velasco on electronic monitoring. The parties shall file their joint supplemental submission on or before December 30, 2025, at which time the Court will take the petition, Docket Item 1, and the government's motion to dismiss, Docket Item 7, under advisement.
