TEXT ORDER granting 2 Motion for TRO. Petitioner has filed a petition for a writ of habeas corpus under 28 U.S.C. § 2241, while being held as a civil immigration detainee at the Buffalo Federal Detention Facility. ECF No. 1. Accordingly, the Court has jurisdiction over this matter. See Rumsfeld v. Padilla, 542 U.S. 426, 44347 (2004). In addition to filing a petition, Petitioner has moved for an ex parte temporary restraining order ("TRO") seeking to enjoin his transfer out of the District. ECF No. 2. Petitioner alleges that his transfer to Louisiana is imminent and such transfer will interfere with his bond hearing, which is scheduled for Friday, June 12, 2026. Because a bond hearing is the relief that Petitioner would most likely receive and in order to facilitate a fair and expeditious resolution of this case, the Court GRANTS the motion for a TRO. Accordingly, Respondents are enjoined from transferring Petitioner out of the District. Petitioner shall file a status report by June 15, 2026, advising whether a bond hearing was conducted.
