ORDER TO SHOW CAUSE: Petitioner's motion 1 is granted in part. By 5:00 p.m. on June 25, respondents are ordered to show cause why an initial custody determination is not required under da Cunha v. Freden, 175 F.4th 61 (2d Cir. 2026) and 8 C.F.R. § 236.1(c)(8). Should respondents acknowledge that the instant petition presents no meaningful distinction from da Cunha, they shall either make an individualized initial custody determination or release him -- in either case, on or before July 1. If he is provided an individualized custody determination, petitioner may then appeal that determination to an Immigration Judge for an individualized bond hearing. The parties shall file a status report on or before July 9, that addresses petitioner's release status. Otherwise, petitioner should serve his reply by 5:00 p.m. on July 9. ORDER ENCLOSED.
