PAPERLESS ORDER: By no later than noon on December 22, 2025, the parties shall submit simultaneous supplemental briefs addressing the following issues: (1) What impact, if any, the ongoing litigation in Maldonado Bautista, et al. v. Santacruz, et al., No. 5:25-cv-01873-SSS-BFM (C.D. Cal.), and in particular the Maldonado Bautista Court's recent certification of a nationwide class, has on this case; (2) How, if at all, the Fourth Circuit's decisions in Jimenez-Rodriguez v. Garland, 996 F.3d 190, 194 n.2 (4th Cir. 2021), and Santana v. Garland, 92 F.4th 491, 497 (4th Cir. 2024), vacated and remanded, 145 S. Ct. 1042 (2025), support or undermine the parties' respective interpretations of 8 U.S.C. § 1225(b)(2)(A); (3) How the other usages of the phrase "seeking admission" in 8 U.S.C. § 1225, specifically at subsections (a)(3) and (a)(5), should inform the Court's interpretation of the phrase's meaning as it is used in 8 U.S.C. § 1225(b)(2)(A); (4) How the Court should rule on the petition if it concludes that 8 U.S.C. § 1225(b)(2)(A) is unambiguous that "applicants for admission" necessarily qualify as "aliens seeking admission" but also finds that interpreting 8 U.S.C. § 1225(b)(2)(A) as applying to all noncitizens who have entered the United States without inspection would render 8 U.S.C. § 1226(c)(1)(E) superfluous and that there is a "longstanding practice of the government," see Loper Bright Enters. v. Raimondo, 603 U.S. 369, 386 (2024) (quoting NLRB v. Noel Canning, 573 U.S. 513, 525 (2014)), of providing bond hearings to noncitizens who have entered without inspection; and (5) How the Court should rule on the petition if it concludes that 8 U.S.C. § 1225(b)(2)(A) is ambiguous about whether "applicants for admission" necessarily qualify as "aliens seeking admission" but also finds that interpreting 8 U.S.C. § 1225(b)(2)(A) as applying to all noncitizens who have entered the United States without inspection would render 8 U.S.C. § 1226(c)(1)(E) superfluous and that there is a "longstanding practice of the government," see Loper Bright Enters., 603 U.S. at 386 (quoting Noel Canning, 573 U.S. at 525), of providing bond hearings to noncitizens who have entered without inspection. PAPERLESS ORDER: In a December 23, 2025 Order, ECF 15, the Court granted the habeas petition and ordered that the petitioner must receive an initial determination by an immigration officer regarding bond or detention within 15 days of the order, and if he was not released on bond by the immigration officer, he was to receive a bond hearing before an immigration judge within 17 days of the order. The parties were directed to file status updates after the proceedings with an immigration officer and immigration judge. To date, no status report has been filed.
