MINUTES for proceedings held before Magistrate Judge Joseph H.L. Perez-Montes: MISCELLANEOUS HEARING held on 1/8/2026. Attorneys Carolyn Hines and Kristin Bayard appeared by video. At this oral argument, the Court ORDERED each party to submit supplemental briefing addressing (1) whether Blanco-Rivero is properly classified under 8 U.S.C. § 1225(b)(2) or is instead subject to detention under § 1226(a); (2) whether Blanco-Rivero has been deprived of any due process rights during his detention; and (3) whether Blanco-Rivero's detention has been punitive and/or indefinite. The parties may additionally brief whether the Court may consider an argument raised for the first time in the reply. The parties' briefs may not exceed 20 pages. Respondents' supplemental brief is due by Friday, January 16, 2026. Blanco-Rivero's supplemental brief is due by Friday, January 23, 2026. The Court additionally ORDERED the parties to file a notice of compliance into the record if a determination is made regarding Blanco-Rivero's presence in the United States prior to this Court issuing a final decision on his petition. At that point, the Court will set a hearing to consider any arguments from the parties regarding the Courts authority and jurisdiction to issue an order that Blanco-Rivero may not be removed until his petition has been decided.
