MINUTE ORDER issued by Relief Courtroom Deputy for Magistrate Judge Sean C. Riordan on 6/11/2026 DIRECTING Respondent to show cause why the writ should not be granted by filing an answer within 7 days. Petitioner may file a reply within 3 days after being served a copy of it. Absent a further order of the court, the petition will be taken under submission after the filing of the reply. The parties shall inform the court as expeditiously as possible in the event that petitioner obtains an immigration bond and it is paid resulting in his/her release or that a travel document is obtained for petitioner that will result in his/her imminent removal from this country. Either party shall update the court by filing a Notice of Changed Circumstances that informs the court of the circumstances that have changed. To ensure this Court's jurisdiction to resolve the pending § 2241 petition, Respondents shall not transfer Petitioner to another detention center outside of this judicial district, pending further order of the Court. FINDINGS and RECOMMENDATIONS signed by Magistrate Judge Sean C. Riordan on 7/1/2026 RECOMMEDNING that the 1 Petition for Writ of Habeas Corpus be granted on claims two and four based on the violation of his Fifth Amendment right to procedural due process and violation of applicable regulations and procedures and Respondents be ordered to immediately release Petitioner Antonio Vargas Cervantes 205-380-366 from their custody and ordered to restore Petitioner's deferred action status to pr ior terms and conditions of his U-visa determination, including the restoration of his temporarywork authorization, and to maintain that status unless Respondents first provide Plaintiff constitutionally adequate notice and an opportunity to be heard and follow the provisions of 8 C.F.R. § 214.14 governing the revocation of approved petitions for U Nonimmigrant Visa Status. It is FURTHER RECOMMENDED at the time of release Respondents return all of Petitioners' documents and possessions and directing the court to enter judgment for Petitioner and close this case. Petitioner Antonio Vargas Cervantes's (A# 205-380-366) application for a writ of habeas corpus 1 is GRANTED as follows: Respo ndents are ordered to IMMEDIATELY RELEASE Petitioner from their custody; Respondents shall RETURN all of Petitioner's documents and possessions upon his release from custody; If the government seeks to re-detain Petitioner, they shall provide him with a bond hearing pursuant to 8 C.F.R. 1236.1(c)(8) at which Petitioner shall bear the burden of showing that he is not a flight risk or a risk to community safety; This order does not address the circumstances in which Respondents may detain Petitioner in the event Petitioner becomes subject to an executable final order of removal and Petitioner receives notice of that final order of removal; Petitioner's motion for a temporary restraining order 10 is DENIED as having been ren dered moot by this order; The Clerk of the Court is directed to serve a copy of this order on the Golden State Annex; and The Clerk of the Court is directed to enter judgment for Petitioner and to close this case.
