ORDER REFERRING CASE to Magistrate Judge Timothy P O'Hara for non-dispositive matters. Pursuant to 28 U.S.C. § 636(b)(1)(A) and (B) and Fed. R. Civ. P. 72(a) and (b), this case is referred to the assigned United States Magistrate Judge to (1) convene a scheduling conference under Fed. R. Civ. P. 16(b) and enter a scheduling order meeting the requirements of D.C.COLO.LCivR 16.2, (2) conduct such status conferences and issue such orders necessary for compliance with the scheduling order, including amendments or modifications of the scheduling order upon a showing of good cause, and (3) hear and determine pretrial matters, including discovery and other non-dispositive motions. Court-sponsored alternative dispute resolution is governed by D.C.COLO.LCivR 16.6. On the request of the parties by motion, this Court may direct the parties to engage in an early neutral evaluation, a settlement conference, or another alternative dispute resolution proceeding. Alternatively, the Magistrate Judge, at their discretion, may convene such early neutral evaluation and/or settlement conferences and direct related procedures as may facilitate resolution of this case without the necessity of a motion or prior authorization of the undersigned. This Court has reviewed the Petition for Writ of Habeas Corpus 2, the Response to the Order to Show Cause by Respondents 9, and the Reply by Petitioner 11 . According to the evidence before the Court, Petitioner was granted parole on December 2, 2022. The Notification to Grant Parole does not state a date for termination of parole. As such, Respondents were required to provide written notice to Petitioner of the termination of his parole. C.F.R. § 212.5(e)(2)(i). Courts have held that failure to provide the statutorily required written notice is a violation of Petitioner's due process rights. See Savane v. Francis, No. 1:25-cv-6666-GHW, 2025 WL 2774452, at *8 (S.D.N.Y. Sept. 28, 2025). There is no evidence in the current record that establishes that Petitioner in this case was provided written notice of termination of his parole. While Petitioner raises a due process claim, he does not specifically address the issue this Court has identified. Accordingly, Petitioner and Respondent are ORDERED to submit additional briefing to this Court identifying whether Petitioner was given written notice, and if not, the effect of that failure, if any, on the claims raised in the Petition.
