ORDER TO SHOW CAUSE: 1. Perez Mujica filed the instant petition on June 9, 2026, requesting that Respondent Jessica Sage (Sage) release him from custody at the Federal Correction Institution Lewisburg (FCI Lewisburg) in Lewisburg, Pennsylvania. (Doc. 1). 2. According to Perez Mujica, the government has detained him at SCI Lewisburg under 8 U.S.C. § 1231 since February 10, 2026, with no credible plan for removal. (Doc. 1, at 1-3). 3. Perez Mujica avers that his prolonged detention under § 1231 violates his Fifth Amendment due process rights as interpreted by Zadvydas v. Davis, 533 U.S. 678 (2001). (Doc. 1, at 1-4). 4. Courts in the Third Circuit have found that petitioners are entitled to supervised release when they sufficiently establish their removal is not reasonably foreseeable and their detention has exceeded the period necessary to secure their removal. 5. The Clerk of Court shall make immediate and proper service of the petition for writ of habeas corpus (Doc. 1) and this Order on Sage. 6. Sage shall not transfer Perez Mujica without further order of this Court. 7. Sage shall file her response to Perez Mujica's petition on or before WEDNESDAY, JUNE 17, 2026. 8.
