TEXT ORDER - The Court has reviewed the Petition for a Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241. (ECF No. 1.) Petitioner has neither paid the required $5.00 filing fee nor submitted an application to proceed in forma pauperis. In addition, the Petition names only the Department of Homeland Security and Immigration and Customs Enforcement as Respondents. In a habeas action challenging present physical custody, the proper respondent is generally the petitioner's immediate custodian, which is ordinarily the warden or facility administrator of the facility where the petitioner is confined. See Rumsfeld v. Padilla, 542 U.S. 426, 434-35 (2004). Accordingly, the Clerk shall ADMINISTRATIVELY TERMINATE this matter. The Clerk shall send Petitioner a form application to proceed in forma pauperis for use by a prisoner seeking habeas relief pursuant to 28 U.S.C. § 2241. Within thirty (30) days of the entry of this Order, Petitioner may move to reopen this action by either paying the $5.00 filing fee or submitting a completed application to proceed in forma pauperis and by filing an amended petition naming the proper custodian as respondent. Upon timely receipt of these materials, the Clerk shall reopen the matter without further order of the Court. The Court's June 9, 2026 transfer-restraining Order (ECF No. 2) shall remain in effect pending further Order of the Court. So Ordered by Judge Karen M. Williams on June 10, 2026.
