EO: The court has received and reviewed Petitioner's 1 Petition for Writ of Habeas Corpus. The Petition appears to raise issues previously addressed by the district court in Rodriguez Nunez v. Arteta, No. 25-cv-9225, 2025 WL 3458587 (S.D.N.Y. Dec. 2, 2025). On or before June 16, 2026, Respondents are ORDERED TO SHOW CAUSE as to the following three questions: 1. Do Respondents believe that there is any factual or legal basis to substantively distinguish this case from Rodriguez Nunez? If Respondents dispute any of the factual allegations in the Petition, they must provide any and all transcripts or other documents necessary for the resolution of those disputes. 2. Notwithstanding Respondents' response to the previous question, do Respondents believe that Rodriguez Nunez was wrongly decided? If the answer to this question is yes, Respondents should explain why, in their view, the court reached the wrong conclusion in Rodriguez Nunez. 3. Do Respondents request the opportunity to offer fuller briefing on any other issue presented in the Petition? Petitioner may file a reply on or before June 23, 2026. This matter is not currently set for a hearing though the court may set one should it later be determined that a hearing is necessary. And given the court's ongoing consideration of Petitioner's Petition, and unless and until the court orders otherwise, the court ORDERS that Respondents shall not transfer or otherwise take Petitioner out of the Eastern District of California. See F.T.C. v. Dean Foods Co., 384 U.S. 597, 604 (1966) (noting court's "express authority under the All Writs Act to issue such temporary injunctions as may be necessary to protect its own jurisdiction"). EO: The court has received and reviewed Respondents' 6 Response to the court's Order to Show Cause, and thanks Respondents for their timely filing. The court wishes to clarify that in his reply, Petitioner may address any issue raised in the Petition, Order to Show Cause, or Response - not just the issues raised in the Order to Show Cause. Petitioner's reply must still be filed by June 23, 2026. In light of this clarification, Respondents will be similarly permitted to file an optional supplement by June 23, 2026, addressing any issue raised in the Petition, Order to Show Cause, or Response. If Respondents wish to stand on the submission in their Response that they "do not request the opportunity for further briefing on any other issues presented in the Petition," Dkt.
