Judge Richard G. Stearns: ELECTRONIC ORDER entered. Petitioner Any Lucia Lopez Belloza attends college in Massachusetts, and prior to enrolling in school here was a resident of Texas. In an affidavit of ICE Assistant Field Director Keith Chan, the government represents that on November 20, 2025, U.S. Customs and Border Protection (CBP) officers, encountered Petitioner at Boston Logan International Airport, took her into custody, and transferred her to the ERO Boston Field Office for processing. Chan Decl. (Dkt #8-1) para. 8. On November 21, 2025, Petitioner was transferred by ICE from Massachusetts to Texas via a flight that departed at 12:27 PM. Id. para. 9. Petitioner arrived in Texas at 4:48 PM on November 21, 2025. Id. At 6:10 PM on November 21, 2025, the federal District Court in Massachusetts issued an Order that "respondents will not remove the petitioner from the jurisdiction of the United States or transfer petitioner to a judicial district outside that of Massachusetts for a period of at least at least 72 hours from the time this Order is docketed." Dkt #2. Petitioner was housed at the Port Isabel detention facility, and on November 22, 2025, ICE put her on a flight that left the United States from Harlingen, Texas at 10:35 AM and landed in Honduras at 1:09 PM. Chan Decl. para. 10. The court will provide petitioner's counsel an opportunity to file a Reply to defendants' Response (Dkt #8) to the petition for Writ of Habeas Corpus (Dkt #1). Stearns: ELECTRONIC ORDER entered granting 52 Motion to Dismiss.Petitioner Any Lucia Lopez Belloza acknowledges that the court previously found habeas jurisdiction lacking in this District. See Opp'n [Dkt # 52] at 10. She nonetheless opposes respondents' motion to dismiss, arguing that (1) the court failed to consider furtiveness as justification for applying the unknown-custodian exception; and (2) because Any was not booked into Port Isabel until after the petition was filed, she remained in the custody of ICE officials in Massachusetts.The second argument is waived. It could -- and should -- have been raised earlier. The court accordingly will focus its attention on the first argument.The court did not ignore the possibility of furtiveness in its earlier order. Even if it had, however, the court clarifies now that it does not see any evidence of furtiveness here. Although the government's hasty removal of Any undoubtedly frustrated counsel's attempts to locate her, there is no evidence that the government was trying to conceal her location or immediate custodian from counsel. She was in Massachusetts for a full day, during which time the system listed her as being detained in Massachusetts. Counsel was hired the same day she was detained and had ample opportunity to file a petition in Massachusetts. When Any was in the process of being moved to Texas, moreover, she disappeared from the system -- a clear indication that she was no longer being detained in Massachusetts. While it is true that the system did not identify her location as Texas when counsel checked again at 5:30 pm, this is hardly surprising, as her plane landed had only landed 42 minutes beforehand. Counsel does not suggest that he continued to monitor the system to see if her location was updated at any point later that evening (by counsel's account, it was at 8:25 pm).The court also finds it significant that respondents clearly identified where Any would have been confined upon her return to the United States (the Southern District of Texas), had she boarded her plane. Because the court's order staying removal would have remained in effect, Any would have had ample opportunity to file a petition in the correct district upon her return -- at least 48 hours, accounting for the notice of intent to remove respondents embedded in their motion to dismiss. (The court does not credit the suggestion that respondents, having just remedied their prior violation of the court's order by returning Any to the United States, would have immediately violated the order again by removing Any from the country without the requisite advance notice.)The sad truth is that when Any declined the flight she also waived this court's only remaining basis for jurisdiction.
