MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 6/9/2026: The court has reviewed Petitioner's 1 Petition for Writ of Habeas Corpus and 2 Motion for Temporary Restraining Order. The court has previously addressed the legal issues raised by Count Two of the Petition. See e.g., Alvarez Maciel v. Noem, No. 1:26-cv-01318-DC-CKD, 2026 WL 496948 (E.D. Cal. Feb. 23, 2026), and Barajas Ortiz v. Chestnut, No. 1:26-cv-01167-DC-SCR, 2026 WL 508419 (E.D. Cal. Feb. 24, 2026). The court is contemplating ruling directly on the 1 Petition, with the understanding that the court will also consider any arguments made and exhibits submitted in support of the Motion for Temporary Restraining Order. See Fed. R. Civ. P. 65(a)(2) ("Before or after beginning the hearing on a motion for a preliminary injunction, the court may advance the trial on the merits and consolidate it with the hearing."); see also 28 U.S.C. § 2243 ("The court shall summarily hear and determine the facts, and dispose of [a petitioner's habeas petition] as law and justice require."); A.R. v. Chestnut, No. 1:26-cv-00551-KES-SAB, 2026 WL 227112, at *1 (E.D. Cal. Jan. 28, 2026) (considering preliminary injunction and merits of habeas petition simultaneously). Respondents shall file an Opposition or Statement of Non-Opposition to the 2 Motion for Temporary Restraining Order by 12:00 PM on 6/11/2026. In their response, Respondents shall substantively address whether there are any factual or legal issues in this case that materially distinguish it from the court's prior orders listed above. Petitioner may file a Reply by 6/12/2026. Both parties should address whether they oppose the court ruling directly on the Petition, albeit as to Count Two only, to the extent a ruling on that Count entitles Petitioner to the relief sought in the Petition. The matter is not set for a hearing though the court may set one should it later be determined that a hearing is necessary. (Text Only Entry) (Deputy Clerk CRS) (Entered: 06/09/2026)

MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 6/23/2026: In Respondents' 6 Opposition to Petitioner's 2 Motion for a Temporary Restraining Order, Respondents distinguish Petitioner's claim from those cited in the court's 5 Order by noting that Petitioner was detained immediately following his arrest for Patronizing a Prostituted Adult. Respondents attach Petitioner's [6-1] Record of Deportable Alien supporting that this was the basis for Petitioner's detention. Petitioner does not dispute this arrest in his 7 Reply. This court has previously found that where the Government asserts a non-pretextual basis for detaining a noncitizen, including interactions with law enforcement, the proper remedy for the Government's failure to provide the Petitioner with a pre-deprivation bond hearing is a bond hearing, not immediate release. See, e.g., Calvillo v. Chestnut, No. 1:26-cv-00569-DC-CSK, 2026 WL 253627 (E.D. Cal. Jan. 31, 2026). Accordingly, Petitioner's 2 Motion for a Temporary Restraining Order is GRANTED as follows: (1) Within fourteen (14) days, Respondents are ORDERED to provide Petitioner Eriks Jesus Rodriguez Sanchez (A-241-431-238) a bond hearing before an Immigration Judge at which the Government shall the burden of proving, by clear and convincing evidence, that Petitioner is either a flight risk or risk to community safety such that Petitioner's continued immigration detention is justified; and (2) If Respondents fail to provide Petitioner a bond hearing within fourteen (14) days, Petitioner shall be immediately released from Respondents' custody on the same terms as Petitioner's previous release. This matter is REFERRED to the assigned Magistrate Judge for further proceedings. (Text Only Entry) (Deputy Clerk CRS) (Entered: 06/23/2026)

FINDINGS and RECOMMENDATIONS (Text Only): Petitioner (A No. 241 431 238) proceeds with a 1 Petition for Writ of Habeas Corpus under 28 U.S.C. § 2241. On 6/23/2026, the District Court judge assigned to this case granted preliminary injunctive relief resulting in Petitioner being provided with a bond hearing by the Executive Office of Immigration Review. The court agrees that under the facts of this case, the relief granted in the 6/23/2026 Order is the appropriate remedy for Respondents' violation of federal law. Since it appears Petitioner was provided the relief ordered, IT IS HEREBY RECOMMENDED that the Petition for a Writ of Habeas Corpus be DISMISSED as moot and this case be CLOSED. These Findings and Recommendations are submitted to the United States District Judge assigned to the case, pursuant to the provisions of 28 U.S.C. § 636(b)(l). Within 14 (fourteen) days after being served with these Findings and Recommendations, any party may file written objections with the court and serve a copy on all parties. Such a document should be captioned "Objections to Magistrate Judge's Findings and Recommendations." Any response to the objections shall be filed and served within 14 (fourteen) days after service of the objections. The parties are advised that failure to file objections within the specified time may waive the right to appeal the District Court's order. Martinez v. Ylst, 951 F.2d 1153 (9th Cir. 1991). MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 9/14/2026: Pursuant to Local Rule 123, the court finds that these actions, Case No. 1:26-cv-04338-DC-CKD and 1:26-cv-07025-DAD-JDP, are related because both cases involve overlapping parties, claims, events and/or questions of fact or law. Thus, the court ORDERS that Case No. 1:26-cv-07025-DAD-JDP is REASSIGNED to U.S. District Judge Dena M. Coggins and Magistrate Judge Carolyn K. Delaney. All future filings shall reflect the judge reassignment and use Case No. 1:26-cv-07025-DC-CKD. (Text Only Entry) (Deputy Clerk CRS) (Entered: 09/14/2026)
