ORDER: Counsel for Petitioner must immediately serve the Petition (Doc. 1) and acopy of this Order on Respondents. If not already issued, the Clerk's Office must issue any properly completed summonses. The Clerk of Court must immediately transmit by email a copy of this Order and the Petition to the United States Attorney for the District of Arizona, to the attention ofMelissa Kroeger at melissa.kroeger@usdoj.gov, Lon Leavitt at lon.leavitt@usdoj.gov, Theo Nickerson at Theo.Nickerson2@usdoj.gov, Dina Anagnopoulos at Dina.Anagnopoulos@usdoj.gov, and Mary Finlon at Mary.Finlon@usdoj.gov. Petitioners Petition for Writ of Habeas Corpus (Doc. 1 ) is granted. Respondents must provide Petitioner a bond hearing within seven (7) days of the date of this Order. The bond hearing shall comport with the procedural requirements of Singh v. Holder, 638 F.3d 1196 (9th Cir. 2011). There must be a contemporaneous record of the hearing, and the Government bears the burden of proving by clear and convincing evidence that Petitioner is a flight risk or danger to the community. In the alternative, the Government shall immediately release Petitioner under appropriate conditions of release. Respondents must provide a notice of compliance within three days ofreleasing Petitioner or providing him a bond hearing.
